Privacy notice.

How we process your personal data under Mexico's Federal Law for the Protection of Personal Data Held by Private Parties (LFPDPPP) and its regulations.

This English version is informative. The Spanish version (Aviso de Privacidad) is the binding text under Mexican law.

1. Identity and address of the responsible party

Enlace Multimodal ARO, S.A. de C.V. (hereinafter "EMA Trade"), with address at Calle Ignacio Zaragoza 330, Edificio Torre Azul interior 302, Niños Héroes, ZIP 76010, Santiago de Querétaro, Querétaro, Mexico, is responsible for the processing of your personal data and for compliance with Mexico's Federal Law for the Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations and other applicable provisions.

2. Personal data we collect

For the purposes described in this notice, EMA Trade may collect the following categories of personal data:

  • Identification data: full name, company you work for, position or role.
  • Contact data: email address, phone number.
  • Data about your operation: information you voluntarily share about your international trade needs (origins, destinations, approximate volume, type of goods and any other data you provide in forms, emails or conversations).
  • Browsing data: IP address, browser type, operating system, pages visited and time spent, collected via cookies and web analytics tools.
  • Virtual assistant conversations: if you interact with our automated assistant, we store the content of the conversation to respond, follow up and improve the service.
  • Application documents: CV and resume data when you send them to us via the "Join us" section.

EMA Trade does not collect sensitive personal data (understood as data that may reveal racial or ethnic origin, health status, genetic information, religious beliefs, political opinions or sexual preference).

3. Primary purposes of processing

Your personal data will be used for the following purposes, necessary for our legal and commercial relationship with you:

  • Respond to requests for information, quotes and advice on our services.
  • Establish commercial contact and follow up on your requirements.
  • Coordinate and provide contracted services in international trade, customs clearance, freight, warehousing, tax and legal advisory.
  • Issue invoices, collect payments and produce contractual documentation.
  • Comply with tax, accounting and customs obligations before the competent authorities.
  • Evaluate talent applications when you send us your CV.

4. Secondary purposes

If you do not express your refusal, we may also use your data to:

  • Send communications about services, regulatory news in the sector and content relevant to your operation.
  • Conduct satisfaction surveys.
  • Internal statistical analysis for continuous improvement of our services.

If you do not wish your data to be processed for these secondary purposes, you may state so by writing to ventas@ematrade.com.mx with the subject "OPPOSITION TO SECONDARY PURPOSES". Your refusal will not be grounds for denying the services you have requested.

5. Transfers of personal data

EMA Trade may transfer your personal data to the following third parties, without requiring your additional consent, pursuant to Article 37 of the LFPDPPP:

  • Allied customs brokers who coordinate the clearance of your goods at the corresponding ports of entry.
  • Carriers, shipping lines, airlines and logistics operators that execute the contracted transport services.
  • Competent authorities (SAT, Mexican National Customs Agency (ANAM), Ministry of Economy, SADER, COFEPRIS and others, depending on the type of goods) when required by law.
  • Technology infrastructure providers (web hosting, statistical analytics and virtual assistant processing), under contractual clauses requiring them to protect your data and process it only for the purposes described in this notice.

All transfers are made only for the authorized purposes. EMA Trade does not sell your personal data.

6. ARCO rights and revocation of consent

You have, at all times, the right to:

  • ACCESS your personal data and learn the details of its processing.
  • RECTIFY data when it is inaccurate or incomplete.
  • CANCEL data when you consider it is not necessary for any of the stated purposes.
  • OPPOSE processing for specific purposes.
  • REVOKE the consent you previously granted.

To exercise any of these rights, send a request to ventas@ematrade.com.mx with the subject "ARCO REQUEST". Your request must include:

  1. Full name and means to receive the response.
  2. Document proving your identity (copy of official ID) or, where applicable, the legal representation under which you act.
  3. Clear and precise description of the personal data on which you seek to exercise the right.
  4. Any element or document that helps locate the data.

We will respond within a maximum of twenty (20) business days, pursuant to the LFPDPPP.

7. Limitation of use or disclosure

You may request that your data not be used for marketing or commercial prospecting purposes by emailing ventas@ematrade.com.mx with the subject "USE LIMITATION".

8. Retention period

We will retain your personal data for the time necessary to fulfill the stated purposes and, subsequently, for an additional period of five (5) years to comply with tax, accounting, customs and legal defense obligations applicable to the international trade sector. After that period, the data will be blocked and deleted pursuant to applicable regulations.

9. Cookies and similar technologies

Our website uses the following technologies:

  • Browser local storage (localStorage): to save your language preference (ES/EN) and the history of your conversation with the virtual assistant while the site is open.
  • Google Tag Manager and Google Analytics: to measure traffic and browsing behavior for statistical and site improvement purposes.

You may disable cookies and local storage in your browser settings. Doing so may affect the functionality of some sections of the site (for example, the virtual assistant will not remember your conversation).

10. Changes to the privacy notice

Any substantial change to this privacy notice will be published on this same page, indicating the last updated date. We recommend reviewing it periodically to stay informed.
